1. The Defendant’s disposition of restricting participation in bidding rendered on October 27, 2016 is revoked.

2. The costs of the lawsuit are assessed against the defendant.

1. Details of the disposition;

A. On November 11, 2015, the Defendant publicly announced the bid for the construction of the traffic management system for the Gangseo-gu Metropolitan Highway Highway (hereinafter “instant construction”) (hereinafter “instant bid”) under Article 2015-1869 of the Seoul Special Metropolitan City Financial Notice.

The main contents of the announcement of this case are as follows.

3. A person who satisfies all of the following qualifications for participation in bidding:

(c)in the last ten years prior to the date of the public announcement of tender, the person shall have a performance in the same (or similar) kind of traffic management system building project with a single completion amount of at least 5.2 billion won.

By December 7, 2015, a certificate of performance for confirming qualification for participation in a tender and a copy of (representative) business registration certificate shall be submitted as traffic information of Seoul Metropolitan Government by December 7, 2015.

If a bidder participates in the tender without submitting a performance certificate, etc., it will be invalid.

A similar traffic management system building project shall include at least three CCTV systems for collecting transport information, including the establishment of the center, such as DSSC, VDS, VDS, ms, LCS, and QWS, and it shall be limited to projects including the establishment of intelligent transport systems (ITS), the establishment of traffic management systems, the establishment of a traffic information system, and traffic informatization.

(B) Any portion not related to the project, such as but not related to the project, such as the ISD, BIT, and charge collection system.

5. Projected price and method of determining successful bidder;

(c) In applying Article 42 of the Enforcement Decree of the Act on Contracts to Which a Local Government Is a Party, and Chapter II of the Criteria for Determination of Successful Bidder at the time of a tender by a local government, the detailed criteria for examination of qualifications for construction of facilities in attached Form 2 shall be applied to the criteria for evaluation of bid construction with a estimated price of less than ten billion won and more

(d) During the performance evaluation, the appraisal of construction experience shall apply to the tender evaluation criteria that limit participation in bidding based on construction performance.

(e) the same (or a similar) type of construction works as that in question during the last ten years with respect to the evaluation of construction experience.
