Defendant shall be punished by a fine of KRW 80 million.

If the defendant does not pay the above fine, 50,000 won.

Punishment of the crime

1. Violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Death or Injury caused by Dangerous Driving) is engaged in driving BM5 automobiles.

On April 21, 2013, at around 23:35, the Defendant driven the above vehicle while under the influence of alcohol of 0.169% with blood alcohol concentration, and driven the internal cycle road located in 207-66, Dongdaemun-gu, Seoul, Dongdaemun-gu, Seoul, along the three-lanes in the direction of the Gangseo-gu, Chungcheongnam-gu, the direction of the river in the direction of the winter-gu.

In such cases, a person engaged in driving of a motor vehicle shall not drive a motor vehicle in a state where normal driving is difficult due to influence of drinking, and has a duty of care to prevent accidents by safely driving such as reporting the traffic situation well, accurately manipulating the steering gear, etc.

Nevertheless, the defendant neglected this and operates the above vehicle while it is difficult to drive it normally due to influence of drinking, and is proceeding ahead of the same direction.

The victim C (the 30-year-old) who was stopped was trying to find out the dial vehicle that was driven by the victim C(the 30-year-old) late, but did not avoid the vehicle, and concealed the part behind the damaged vehicle into the front part of the Defendant's vehicle, and led the victim E(the 36-year-old) who was stopped in the front.

2. On April 21, 2013, the Defendant violates the Road Traffic Act (driving).
