Punishment of the crime

1. The Defendant in violation of the Act on Special Cases Concerning the Settlement of Traffic Accidents is a driver with no number plate 50cc non-ono.

On May 4, 2013, at around 00:48, the Defendant driven the above Otoba while under the influence of alcohol with 0.136% of blood alcohol concentration 0.136%, and turned about about 385 lanes from Incheon to 40km/h in accordance with the Seoul direction.

In such cases, a person engaged in driving of a motor vehicle has a duty of care to prevent accidents in advance by driving the motor vehicle in a safe manner by taking the front side and left side well and safely.

Nevertheless, the defendant neglected to drive the vehicle and changed from the front to the four-lanes of the victim B's driver's CEX car to the left side of the driver's vehicle in front of the same lane, and the victim D, who is accompanied by the lower part of the victim's vehicle in front of the victim's vehicle, was faced with the left side of the damaged vehicle and got the victim D to go beyond the road.
