1. The part of the claim for nullification of the reprimand disposition among the lawsuits in this case shall be dismissed.
2. The plaintiff's remaining claims are dismissed.
Reasons
1. Basic facts
A. B, around December 2007, acquired C (hereinafter “C”) a company, which was under the workout program, and thereafter, increased C’s sales revenue amounting to KRW 2.8 billion in 2007 to KRW 20.8 billion in 2007.
B, however, due to the U.S. financial crisis that started at the end of 2008, the pressure of operating funds continues to be serious and requested to the creditor group (new bank, our bank, defendant, etc.), but the creditor group rejected C's request for financial assistance for reasons such as lack of collateral.
B. C’s graduation from the workshop and U.S. No. 1) B did not accept the funding required by the claim group. A around March 2009, upon obtaining a loan from the Bank as security for the factory of C, and repaid the obligations to the claim group, and upon graduation from the claim group, set up a plan to receive a guarantee support from the Defendant, and then requested the claim group to graduate from the workshop with the above contents, and at the time, Defendant D (hereinafter “D”).
(2) The Plaintiff, the head of the branch office of Korea, requested the Plaintiff to provide support for the amount of KRW 2 billion when the graduation from the workshop was decided through the loan of the Bank, and the Plaintiff instructed the former Defendant EF to examine whether to provide support for the amount of KRW 730 million. Meanwhile, at the time, C had already been liable for the reimbursement of KRW 7330 million against the Defendant. However, B failed to obtain a loan from the Bank due to the shortage of security, etc., and the graduation from the workout program on March 30, 2009 was nonexistent.
C. On April 2009, 1B sought H, a branch director of the New Bank G branch of the Bank, from the early April 2009, to support the graduation of the workshop and the Defendant’s new guarantee implementation status by explaining the current status of the Defendant’s new guarantee implementation through the loan of the Bank. The purpose of this study is to confirm whether H is possible to graduate from the workshop through the loan of the new bank.
