A defendant shall be punished by imprisonment for not less than one year and six months.
Reasons
Punishment of the crime
1. On October 2009, the criminal defendant against the victim C made a false statement to the victim C at the coffee shop near the Gyeyang Apartment Apartment apartment near the member-gu, Ansan-si, Ansan-si, stating that “If he transfers money to the private school support fund, he/she may allow his/her father/child to be employed as a regular teacher of a private school.”
However, even if the defendant receives money from the above victim as a support payment for a private school, he did not have the intention or ability to allow the victim to be employed as a regular teacher of a specific private school.
On November 16, 2009, the Defendant was transferred KRW 10,000,00 to an account in the name of the Defendant, as a support payment for private schools on November 16, 2009.
In addition to this, the Defendant received a total of KRW 66,50,000 as a private school support fund through five times in total, such as the attached list 1 in the attached crime list.
2. On November 12, 2010, the Defendant made a false statement that “F” in the business name “F” in Gyeonggi-si, Gwangju-si, intended to assist the victim D to employ his or her descendants as a regular private school teacher by paying for entertainment expenses to the private school in Gyeonggi-do and the Gyeonggi-do Office of Education.”
However, even if the defendant received entertainment expenses from the above victim, he/she did not have the intent or ability to allow the above victim's incidental children to be employed as the regular teachers of a specific private school by paying entertainment expenses to the private school in Gyeonggi-do and the related persons of the Gyeonggi-do Office of Education.
The Defendant received 10,000,000 won as entertainment expenses from the victim, namely, at the time of the above false statement, from the victim to the account under the name of the Defendant.
The defendant as well as the defendant in the above manner.
