Punishment of the crime

1. Defendant A, E, and F’s joint crime was committed as the owner of L Gameland in Busan-gu K and the third floor, and Defendant E and F conspired to operate the above game hall, and to act as an employee to enter and delete game machine scores to customers and to clean up the game machine scores.

게임 물 관련 사업자는 게임 물을 이용하여 도박 그 밖의 사행행위를 하게 하거나 이를 하도록 내버려 두면 아니 됨에도, 피고인들은 2015. 10. 초순경부터 2015. 10. 12. 경까지 약 10일 동안, 위 L 게임 랜드에서 지문인식 기와 게임 장 관리 컴퓨터를 이용하여 손님들 별로 구분하여 점수를 관리하고 손님들 요청에 따라 게임기에 점수를 입력해 주거나 삭제해 주는 방식으로 운영하면서, 삼국 명장, 판타지 아, 월드 스토리, 청산 게임기 89대를 설치하고 손님들이 게임기에 현금을 투입하거나 손님들 요청에 따라 게임 장 관리 컴퓨터에 보관 중인 점수를 게임기에 넣어 주고 게임기를 실행한 후 자동 진행장치( 일명 ‘ 똑딱이’ )를 올려놓으면 게임이 자동으로 진행되면서 5 장의 카드가 배열되어 원 페어, 투 페어, 트리플 등 포커와 동일한 방식으로 카드가 배열될 경우 당첨이 되는 방식으로 우연에 의해 손님들이 점수를 획득하면, 환전상 길잡이인 C은 매일 1회 20:00 경 게임 장 내부를 돌아다니면서 환전을 원하는 손님을 확인하여 게임 장 건물 계단에서 대기하고 있는 환전상 D에게 안내하여 손님이 획득한 점수를 만원 단위로 환산하여 수수료 10%를 공제하고 환전하게 하였다.
