The prosecution of this case is dismissed.

1. Around 05:00 on August 28, 2014, the Defendant: (a) committed assault, such as, on the part of the victim’s left eye, the Defendant was a ice cream that was frighted for drinking on the ground that the victim E (Nam, 22 years of age) was changed from the restaurant of “D” located in the Young-si flooding Area C; and (b) assaulted the victim’s left eye.

2. The facts charged in the instant case are crimes falling under Article 260(1) of the Criminal Act and cannot be prosecuted against the victim’s express intent under Article 260(3) of the Criminal Act. According to the records, on January 22, 2015, after the institution of the instant indictment, a written agreement was submitted by the victim that expressed his/her wish not to punish the Defendant, and thus, the instant indictment was dismissed pursuant to Article 327 subparag. 6 of the Criminal Procedure Act.
