A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. The Defendant and C et al., who opened a gambling place, run a gambling site in which sports promotion betting tickets are issued, betting tickets are predicted, and the Defendant and C et al., operate the gambling site to obtain or lose game money according to the results of the sports games. C and D, who invest initial funds and operate the gambling site, and E, who takes charge of the overall management of the Chinese Cheongdo office in which the gambling site server is located, and the Defendant and F, G, H, I, and J, who are the Defendant and F, H, I, and the Korea Cheongdo office in order to play a role of charging and exchanging money at the Chinese Cheongdo office.
Accordingly, the Defendant, along with C, operated L with C, from March 2016 to July 3, 2016; from November 18, 2016 to August 4, 2017; from June 26, 2016 to July 3, 2016, the Defendant paid members a total of KRW 14,709,876,242 as shown in the separate crime list from around November 18, 2016 to around July 4, 2016, and paid members a certain amount of money in accordance with the result of betting before the member was held at home and abroad, along with the result of betting.
Therefore, even though the defendant is not an entrusted business entity of the Seoul Olympic Sports Promotion Foundation, the defendant issued similar things to the sports promotion voting rights and provided property or property benefits to those who win the result, and opened a space for gambling for profit purposes.
2. The Defendant, who acquired criminal proceeds, etc., in collusion with C, etc., operates the gambling site as above, is so-called a so-called passbook, such as (N) company bank account in the name of M of Limited Company M, (P) bank account in the name of PO, (R) bank account in the name of Q Qa Co., Ltd., (T), (T) bank account in the name of S, (V), U’s postal bank account in the name of U, and (W) company bank account in the name of X, (Y) bank account in the name of X, and agricultural bank account in the name of H.
