A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

[2018 Highest 1923]

1. On December 10, 2017, the Defendant posted a game item on the online te-te-te-te-te-te-te-te-te-te-te-te-te-te-te-te-te-te-te-te-te-te-te-te-te-te-te-te-te-te-E-O-E-E-E-E-O-E-E-E-E-E-E-E-O-E-E-E-E-E-O-E-E-O-E-O

However, the defendant did not have the intent or ability to send a game item, even if he did not receive money from the injured party, because he lives in a soup room or game room at the time, and he thought that he will receive money from the injured party for the cost of living.

Defendant deceiving the victim as above and received 35,000 won from the company bank account (Account Number: D) in the name of the Defendant’s name for the sale price of game items from the victim, and acquired it by transfer from 11 victims total amount of KRW 74,800,00 as shown in attached Table 1, from May 9, 2018.

2. 컴퓨터 등 사용 사기 피고인은 2018. 4. 11. 경 대전 서구 E에 있는 피고인의 고등학교 동창인 피해자 F의 집에 찾아가 피해자에게 “ 휴대전화로 게임을 하려고 하니 휴대폰을 빌려 달라. ”라고 거짓말을 하여 건네받은 다음, 피해 자로부터 소액 결제를 하겠다는 허락을 받지 아니하고 온라인 게임 사이트인 넥슨에 평소 알고 있던 피해자의 성명, 생년월일, 휴대전화번호를 입력하고 휴대폰 인증을 한 후 150,000원을 결제한 것을 비롯하여, 그 다음날까지 별지 범죄 일람표 2 기 재와 같이 총 17회에 걸쳐 합계 999,600원을 결제하여 동액 상당의 재산상 이익을 취득하였다.
