Reasons
Punishment of the crime
1. The Defendant, as a manager of Fpenta from December 2, 2009 to May 13, 2014, has been engaged in the business of managing revenues, such as the fee for using the penta, etc.
The Defendant was working as the sole manager of the above penta, and the Victim G Management Committee settled the revenue and expenditure of the penta at least once a year when the H beach was closed, and attempted to settle the fee collected from the users of the above penta as if he were to use it as expenses, or to make an embezzlement after settling as if he did not generate any income.
On October 20, 2010, the Defendant received fee of KRW 300,000 from the users of the above penta in the Nong account (Account Number:J) and kept in custody for the victim on his/her duty, and deposited KRW 300,000 as above in cash and deposited in the K K K Securities account (Account Number: L) in the same day, and invested in the futures option.
In addition, from October 1, 2010 to October 30, 2013, the Defendant: (a) received user fees from the above pension users in cash from the above pension users; (b) deposited in the agricultural bank account in the name of I; (c) deposited in the post office account in the name of M; and (d) deposited in the account in the name of M and kept in custody for the victim; (c) from October 20, 2010 to October 30, 2013, the Defendant paid off money to the SK account in the name of K (Account Number: L); (d) invested in the gift option account in total on 116 occasions; (e) deposited the account in the name of the aboveO into the SK account in the name of the aboveO; and (e) repaid money to the personal rehabilitation account in the name of the aboveO; and (e) paid out 100,000 won to the personal rehabilitation account in the name of the aboveO; and (e) paid out 10,015
Accordingly, the defendant embezzled the victim's property.
