The appeal is dismissed.
The costs of appeal are assessed against the defendant.
Reasons
The grounds of appeal are examined.
For the reasons indicated in its holding, the lower court determined that the act of the Defendant’s act of entering into the instant sales contract with respect to each real estate listed in Annex A at the time of original adjudication between the Defendant and the Defendant constitutes a fraudulent act, and rejected all the Defendant’s assertion that the instant sales contract is not a fraudulent act, or that the Defendant’s act of entering into the instant sales contract is a bona fide beneficiary, since it inevitably financed new funds from the Defendant to resolve the financial difficulties and continue the business
In light of the relevant legal principles and records, the above determination by the court below is just, and contrary to what is alleged in the grounds of appeal, there were no errors by exceeding the bounds of the principle of free evaluation of evidence against logical and empirical rules, by misapprehending the legal principles on fraudulent act, the good faith of beneficiaries
Therefore, the appeal is dismissed, and the costs of appeal are assessed against the losing party. It is so decided as per Disposition by the assent of all participating Justices.
