Reasons
The grounds of appeal are examined.
For the reasons indicated in its holding, the lower court determined that each of the instant mortgage contracts constitutes a fraudulent act as it concluded with the Defendant, which is a specific creditor, rather than for receiving goods from a continuous transaction between B and B in excess of the obligation, and rejected the Defendant’s assertion that the Defendant is a bona fide beneficiary, on the ground that the evidence submitted by the Defendant alone is insufficient to recognize it.
In light of the relevant legal principles and records, the above determination by the court below is just and acceptable, and contrary to the allegations in the grounds of appeal, there is no violation of the rules of evidence or misapprehension of legal principles as to fraudulent act and the good faith of beneficiaries.
Therefore, the appeal is dismissed, and the costs of appeal are assessed against the losing party. It is so decided as per Disposition by the assent of all participating Justices on the bench.
