A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

1. Fraud against victim D;
A. The defendant around May 20, 2001, at the “F” restaurant located in Yongsan-gu Seoul Metropolitan Government E, and at the same year, he/she lent 6 million won to the victim D with “emergency use.”

The Defendant made a false statement. However, while at the time, the Defendant had a debt, such as a financial institution and bonds, etc., 100 million won at the time, the Defendant did not have any other property, and there was no income other than 10 million won, and thus, was urgencyed to repay the existing debt even if the Defendant borrowed the money from the said victim. Nevertheless, the Defendant was given 6 million won from the said victim as a loan, namely, at the victim’s seat. However, the Defendant was given 6 million won from the said “F” restaurant on June 25, 2001. The Defendant would pay 6 million won prior to the loan of 4 million won from the victim D at the said “F” restaurant on the same day.
The Defendant made a false statement. However, the Defendant did not have any intent or ability to repay the money even if he borrowed the money from the victim as above, because the Defendant was an urgent situation in excess of a large amount of obligation as seen above. Nevertheless, the Defendant was granted KRW 4 million from the victim, namely, at the seat of the Defendant. Accordingly, the Defendant, by deceiving the victim and received KRW 10 million from the victim on two occasions. On April 2001, the Defendant, against the victim C, etc., was provided KRW 10 million. On the other hand, the Defendant, against the victim C, etc., at the “G Ga,” located in Yongsan-gu Seoul Metropolitan City, with the victim “A” in the “G Ga,” which had been operating the fraternity as the main agent for raising KRW 1 and 2, and paid KRW 30 million.
