피고인은 2016. 10. 28. 00:30경 안양시 만안구 박달우회로 134 은하수아파트 앞 노상에서 ‘대리 운전을 한 손님이 일어나지 않는다’는 내용의 112신고를 받고 출동한 B지구대 소속 경찰관인 경장 C로부터 대리요금을 지불하고 귀가할 것을 수차 요청받자 “씨팔 놈아, 내가 뭘 잘 못 했어, 씨팔 해봐, 씨팔 놈아 좆같은 소리하고 있네, 입건해 씹새끼야, 개새끼 죽여 버려.”라고 욕설을 하며 손으로 C의 가슴을 2회 밀치고 오른쪽 발을 들어 다리를 차려고 휘두르는 등 폭행하여 경찰관의 112신고 사건 처리에 관한 정당한 직무집행을 방해하였다.
