A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On August 24, 2018, the Defendant, in violation of the Act on Fraud and the National Health Insurance Act, committed the following acts on August 24, 2018: (a) at the time of receiving the patient, the Defendant, by deceiving the employees and doctors of the above hospital by means of name and resident registration number D at the time of receiving the patient; and (b) ordered the National Health Insurance Corporation, the victim, to pay KRW 10,810 as insurance benefits; and (c) from that time, the Defendant, as described in the list of crimes (1) in attached Form 48 times in total, charged the victim with the total amount of KRW 874,966 by the National Health Insurance Corporation.

Accordingly, the Defendant, by deceiving the victims of the National Health Insurance Corporation, obtained property benefits equivalent to the above amount, and received national health insurance benefits by fraud or other improper means.

2. The Defendant violated the Resident Registration Act: (a) obtained treatment using D’s resident registration number at the date and place under paragraph (1) and prescribed medicine; and (b) used another’s resident registration number unlawfully via the foregoing 48 times in total as indicated in the list of offenses (1).

3. The Defendant is not a person handling narcotics, etc.

B. On August 24, 2018, at the Defendant’s office located in Daegu Suwon-gu, the Defendant administered strokes using the stroke method, which is a psychotropic drug purchased as above.
