1. The Defendant: (a) KRW 3,871,380; and (b) KRW 11,428,571; (c) Plaintiff G, H, I, J, J, K, L, M, and N, respectively. KRW 2,952,380.
Reasons
1. Basic facts
A. On October 31, 1968, Plaintiff A returned to North Korea on October 31, 1968, returned to the Incheon Port, and was investigated by the East Incheon Police Station on November 4, 1968, and was detained on the charge of violation of the anti-public law and the Fisheries Act. On November 22, 1968, Plaintiff A was investigated into the custody of Plaintiff A on November 22, 1968. The detention warrant was issued on November 22, 1968 and executed around that time. 2) The investigator of the Gunsan Police Station, etc., who was affiliated with the Gunsan Police Station, forced Plaintiff and co-suspects to make a confession in the absence of permission, etc. while forcing Plaintiff and co-suspects to make a confession during the aforementioned illegal detention.
In the process, the plaintiff A and the co-suspects prepared a suspect examination protocol with the content that confessions the facts of suspicion.
In addition, the police officer who investigated the plaintiff A was present in the prosecutor's office to create a dangerous atmosphere.
3) After completion of the above investigation, Plaintiff A was indicted for a violation of the Public Law and the Fisheries Act as follows. On February 20, 1969, the former District Court rendered a judgment of conviction as to all the facts charged and sentenced Plaintiff A for one year of imprisonment and suspension of qualification and two years of suspended execution. The above judgment became final and conclusive (hereinafter “the judgment of review”).
The plaintiff A was detained for 109 days.
Defendant C of the facts charged is the captain of R R owned by Q residing in the military, and the same S is the head of the same R, and the same T, U, V, and A are the crew members of the R, respectively.
