1. Basic facts

가. 이 사건 토지의 현황 1) 이 사건 토지는 ① 별지2 도면 표시 1, 2, 3, 18, 19, 20, 14, 15, 16, 17, 1의 각 점을 차례로 연결한 선내 ‘가’ 부분 635㎡(이하, ‘㈎ 부분 토지’라 한다

), ② 같은 도면 표시 3, 4, 5, 6, 7, 8, 9, 22, 21, 12, 13, 14, 20, 19, 18, 3의 각 점을 차례로 연결한 선내 ‘나’ 부분 165㎡(이하, ‘㈏ 부분 토지’라 한다

), ③ 같은 도면 표시 12, 21, 22, 9, 10, 11, 12의 각 점을 차례로 연결한 선내 ‘다’ 부분 6.0㎡(이하, ‘㈐ 부분 토지’라 한다

)로 이루어져 있다. 2) ㈎ 부분 토지와 ㈏ 부분 토지의 경계 중 별지2 도면의 점 3과 점 18 사이에는 담장이 설치되어 있고, 점 18과 점 13 사이에는 위 담장과 연결된 출입문이 설치되어 있다.

3) ㈏ 부분 토지는 현황이 도로이고, 그 북서쪽 끝(별지2 도면의 점 3과 점 4 사이 부분)이 공로인 부산 금정구 E 토지(이하, ‘이 사건 도로’라 한다

)에 연결되어 있기 때문에, ㈎ 부분 토지를 포함하여 인근 토지의 소유자들이나 점유자들이 이 사건 도로로 출입하기 위한 통로로 사용하여 왔다. 나. 이 사건 토지 등의 소유관계 1) 이 사건 토지는 원래 F(피고 B의 배우자이자 피고 C의 아버지)가 단독으로 소유하고 있었는데, 그 중 150/806 지분에 관하여 1987. 8. 24. 매매를 원인으로 하여 1987. 8. 25. G(원고의 아버지) 앞으로 소유권이전등기가 마쳐졌다.

2) Upon the death of F, the Defendants completed the registration of ownership transfer for one half of F shares (656/806 shares) of each of the instant land (for each of the Defendants, 328/806 shares) on the grounds of inheritance by agreement and division dated August 4, 2002. After the death of G, the Plaintiff completed the registration of ownership transfer for the portion of 150/806 shares out of the instant land due to inheritance by agreement and division dated June 3, 2010.
