A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

피고인은 2016. 12. 4. 02:00 경부터 같은 날 04:00 경까지 사이에 제주시 B에 있는 ‘C 펜 션 ’에서 전날 행사에서 함께 공연을 하며 알게 된 피해자 D( 여, 20세) 이 거실 침대에서 잠을 자고 있는 것을 보고 피해자의 뒤에서 양팔로 피해자를 껴안고 이에 잠에서 깬 피해자의 상의 안으로 갑자기 손을 넣어 피해자의 가슴을 만지고 피해자의 어깨를 피고인의 몸 쪽으로 당겨 피해자의 팔을 잡아 움직이지 못하게 한 뒤 피해자의 입술에 입을 맞추고 입 안에 혀를 넣고 피해자의 목을 핥고 피해자가 반항하는데도 피해자의 팔을 잡아 움직이지 못하게 한 뒤 피해자의 상의를 올려 혀로 가슴을 핥고 손으로 가슴을 만지고 피해자의 하의 안으로 손을 넣어 음부를 만져 피해자를 강제 추행하였다.
