A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

피고인은 2018. 6. 12. 19:30 경 목포시 C에 있는 피해자 D( 여, 26세) 의 주거지에서, 평소 동업관계에 있는 피해자의 모친 등과 술을 마시다 어업 준비를 위해 잠시 방에 누워 있던 중 피해자를 보고 순 간 욕정을 느껴 피해자의 손목을 잡아 옆에 앉힌 후, 교통사고로 다리를 제대로 움직이지 못하는 피해자의 다리를 손으로 쓰다듬듯이 만지고, 피해자가 ‘ 하지 말라’ 고 하면서 뿌리쳤음에도 계속해서 강제로 자신의 품안으로 끌어안아 피해자의 상의를 걷어 올려 가슴을 만지고, 팬티 속으로 손을 넣어 음부를 만지다가 질 안으로 손가락을 집어넣었다 빼는 행위를 반복하고, 계속해서 피해자가 ‘112 신고를 하겠다’ 고 소리를 지르며 제지하려고 하였으나 힘으로 피해자의 팔을 제압한 후 강제로 피해자의 팬티를 허벅지까지 내려 입으로 음부를 핥고, 다시 한 손으로 윗옷을 올려 양쪽 가슴을 번갈아 빨고 다른 한 손으로 질 안으로 손가락을 집어넣었다 빼는 행위를 수회 반복하였다.
