Reasons
Punishment of the crime
[Criminal Power] On December 11, 2018, the Defendant was sentenced to imprisonment with prison labor for larceny, etc. at the Gwangju District Court, and completed the execution of the sentence in the Gwangju Prison on December 11, 2018.
【Criminal Facts】
1. Larceny;
A. On March 25, 2019, the Defendant: (a) around 03:12 on March 25, 2019, opened a door that was parked in the front parking lot of Seo-gu, Seo-gu, Seo-gu, Seo-gu, Gwangju, and cut off cash worth of KRW 70,000,000, which is the victim’s possession, from the wall that was located in the contact bed.
B. On March 31, 2019, the Defendant, around 00:52 on March 31, 2019, opened a door that was parked at the parking lot in Seo-gu, Seo-gu, Seo-gu, Gwangju, and cut off the cash amount of KRW 370,00,000 owned by the victim on the ground that he was parked at the parking lot of the G-gu, Seo-gu, Gwangju, and cut off the 370,000,000 won.
C. On April 10, 2019, the Defendant: (a) around 03:07 on April 10, 2019, the Defendant: (b) opened a door that was parked in the front side of the J building in Seo-gu, Seo-gu, Seo-gu, Gwangju; and (c) cut off the cash amounting to KRW 4.50,000,000, in cash, owned by the victim, from the land on which he was placed in the driver’s seat.
2. Attempted larceny;
A. At around 03:00 on May 11, 2019, the Defendant: (a) opened a door of a Nstoke car managed by the victim L, which was parked in front of the Seo-gu, Seo-gu, Gwangju, Gwangju; (b) attempted to steals money and valuables; (c) but (d) failed to bring the door of the car to the end of the car.
B. At around 03:10 on May 11, 2019, the Defendant: (a) opened a door of a RWz car managed by the victim O, which was parked in Q&C located in the Seo-gu P, Seo-gu, Gwangju; (b) attempted to steal money and valuables; (c) but (d) failed to bring the door of the car into the car, and thus, did not constitute an attempted crime.
