1. The Defendant (Counterclaim Plaintiff) paid KRW 68,050,000 to the Plaintiff (Counterclaim Defendant) and its related amount from October 20, 2017 to November 27, 2018.

1. Facts of recognition;

A. On November 3, 2015, the Defendant, a company established on November 3, 2015 to conduct real estate development business, planned to construct two apartment complexes of ten stories above ground (hereinafter referred to as "one apartment complex" among the above apartment complexes, and the apartment complexes to be newly constructed on the ground; hereinafter referred to as "two apartment complexes") on December 24, 2015, in a single unit of 2,197 square meters and B 1,362 square meters (hereinafter referred to as the "project site of this case"), located in the area of ten stories above ground. The Defendant purchased the above business site on December 24, 2015.

B. From around 2015, the Defendant had had consultation with the Plaintiff regarding the construction design service of the apartment complex of the first and second complexes with the Plaintiff, and had entered into the said construction design service contract with the Plaintiff by dividing it into a complex (hereinafter “first design service contract regarding apartment complex”) on June 2016 (hereinafter “the first design service contract regarding apartment complex”) and the main contents of the said contract are as follows.

3. Design: 1) Site area: For the purpose of use: Multi-family housing (multi-family housing) structure: Building area of 10,197 square meters: 5 square meters on land: Total floor area of 700.909 square meters on land: 5,228.3246 square meters (1,582 square meters).

4. Contract area: 5,228.3246 square meters (1,582 square meters).

5. Contract amount: 582 x 50,000 won energy design (construction): 5,000,000 won for design cost of KRW 93,100,000: The amount of civil engineering design of KRW 4,000,000: Total amount of KRW 5,000,000: Article 3 (Scope, etc. of Contracts) (1) of the "Standard Contract for Building Design" of Article 209-1092, which is announced by the Ministry of Land, Transport and Maritime Affairs;

(2) Necessary for design affairs, such as the preparation of work completion books and building management books.
