A defendant shall be punished by imprisonment for eight years.

The defendant shall complete 160 hours of sexual assault treatment program.

Punishment of the crime

1. 성폭력범죄의처벌및피해자보호등에관한법률위반(친족관계에의한강간), 아동ㆍ청소년의성보호에관한법률위반(강간) 피고인 겸 피보호관찰명령청구자(이하 ‘피고인’이라 한다)는 2010.경 의왕시 C에 있는 자신의 집 방 안에서, 학교 숙제를 위해 피고인의 컴퓨터를 쓰겠다고 하는 여동생인 피해자 D(당시 13세)에게 ‘내 성기를 핥아주면 컴퓨터를 쓰게 해 주겠다’고 하여 피해자로 하여금 자신의 성기를 빨게 한 다음 피해자와 성교하려 하였다.

Accordingly, the defendant raped the victim who is a juvenile who has kinship with the female.

2. Violation of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes and Violation of the Act on the Protection of Children and Juveniles against Sexual Abuse;

A. After graduating from a high school, the Defendant entered the Army on November 20, 2012, and returned to the Republic of Korea on September 20, 2013.

Around September 2013, the Defendant: (a) forcedly placed the victim who refused to accept a sexual intercourse (at that time, 15 years old); (b) placed the victim on the bed; and (c) placed the victim’s body on the bed; and (d) inserted his sexual organ into the part of the victim’s sexual organ into the part of the sexual organ; and (b) raped the victim, who is a juvenile of a female-child relationship.

B. On November 23, 2014, around 15:00, the Defendant: (a) sought to talk with the victim (at that time, 16 years of age) who was living in his/her own house, but the victim was soundingd with his/her large interest; (b) she resisted the victim with his/her house; (c) she resisted him/her with his/her house; and (d) she resisted him/her with his/her fingers; and (d) resisted him/her with his/her finger
