Punishment of the crime

The husband of the defendant and the victim B are internal relations.

No one shall repeatedly send any codes, language, sound, image, or motion picture that arouses fear or apprehension through an information and communications network to any other person.

그럼에도 불구하고 피고인은 2018. 11. 13. 23:13경 불상지에서 피고인의 남편과 피해자가 불륜관계를 저지른 사실을 알고 피해자에게 ‘미췬 잠자는 사자의 코털을 건드리냐 ’, ‘피한다고 될 일이 아닐텐데 사진 여러장 인화해서 낼 회사로 갈까 ’, ‘생각 바뀌면 전화해라. 아님 낼 회사서 보던가’라고 문자를 전송한 것을 비롯하여 2018. 12. 4. 11:57경까지 별지 범죄일람표 기재와 같이 총 8회에 걸쳐 반복적으로 문자를 전송하여 피해자로 하여금 공포심이나 불안감을 유발하게 하였다.

1. The defendant asserts that he sent letters as stated in its reasoning to the effect that he did not contact the victim but caused a telephone. According to the evidence duly adopted and examined by this court, the defendant mentioned that he would have to find the victim's body photographs sent by the victim to her husband as the company where she would have worked, or that she would have found the victim's her parent's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son.

In full view of these circumstances, the defendant's act goes beyond the purpose of simply requesting contact to the victim, considering the number of times when the defendant sent letters, interval and contents thereof.
