A defendant shall be punished by imprisonment for one year.
Reasons
Punishment of the crime
No one shall repeatedly send any codes, words, sound, image, or motion picture that arouses fear or apprehension to any other person.
On March 2010, the Defendant continued to return to the victim immediately after the victim B came to know that he was dead with her husband before the Defendant was a her mother, who was the Defendant’s alumni. However, the Defendant and the victim requested that the victim explicitly refuse to communicate and no longer communicate with the victim, and repeatedly reported the victim’s false disappearance in 112 on the ground that the victim did not receive the phone number. On March 2010, when the victim cancelled the blocking of the Defendant’s phone number repeatedly, the text message was sent to the victim’s cell phone number immediately after the victim was dead, and the victim, such as the Defendant’s cell phone number 1,618 times with the victim’s cell phone number, was a situation in which the victim feel fear or apprehension due to Defendant’s text message.
Nevertheless, on January 17, 2018, the Defendant transmitted to the victim the word “Neman Love” at a place where the place is unknown, from that time until September 25, 2019, the Defendant sent the word “Neman Love” to the victim, along with a total of 10 times from that time, and repeatedly sent the word causing fears or apprehensions to the victim, such as the written list of crimes in the attached Table.
