1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. On August 26, 2013, the Defendants: (a) against the Plaintiff, a patentee, the Intellectual Property Tribunal; and (b) the instant patent invention is a person with ordinary knowledge in the technical field to which the invention pertains (hereinafter “ordinary technician”).
(2) On January 30, 2015, the Intellectual Property Trial and Appeal Board filed a petition for a trial for invalidation of registration (2013DaDa2307) by asserting that the nonobviousness of the invention can be easily denied from prior inventions. (2) On January 30, 2015, the Intellectual Property Trial and Appeal Board rendered the instant trial ruling accepting the request by the Defendants on the ground that the nonobviousness of the patented invention
B. The Plaintiff’s title of the patented invention (Evidence 2) 1 of this case: The Plaintiff’s use of heat in a liquid display device, such as DOED, LED, by removing the non-nets of the materials, and the use of heat in a heating device (see e.g., 003 to 008). The date of application (see e.g., e., e., 003 to 008) / the date of registration / the registration / the registration number / the claims / e/ G 3 / the claims / e/ G 1 of the instant patent invention / the multiple painting with the equipped home, and the string unit (hereinafter “ente. 1”).
