이에 피해자가 경찰에 신고를 하고 기다리고 있는데 피고인이 호프집 밖으로 나가자 피해자가 따라 나와 “경찰에 신고했는데 어디를 가느냐”라고 묻자 갑자기 양 주먹으로 피해자의 온 몸을 때렸고, 이에 쓰러져 겁을 먹은 피해자가 피고인의 왼팔을 깨물며 반항하자 오른손 손바닥과 오른발 발바닥으로 피해자의 왼쪽 뺨 부위를 수차례 밀치고 밟았으며, 이어서 피해자가 깨물던 이빨을 놓자 피해자의 배 위에 올라타 양 주먹으로 피해자의 얼굴과 이마 부위를 수차례 때렸고, 다시 일어나 오른 발로 피해자의 왼 쪽 옆구리를 수차례 걷어찼으며, 다시 양 손으로 피해자의 멱살을 잡고 일으켜 양 주먹으로 가슴과 얼굴을 수차례 때려 피해자에게 약 2주간의 치료가 필요한 안면부 기타 표재성 손상 등을 가하였다.
