A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date of the final judgment.

Punishment of the crime

The Defendant resided in the construction site of Busan Shipping Daegu Building C and worked as a daily worker in Busan D, while E (28 years of age) resided in the F apartment of Busan Shipping Daegu, and worked as a daily worker in the same construction site as the Defendant, while living in the F apartment of Busan Shipping Daegu.

On May 3, 2018, the Defendant reported 112 to the G District Unit of the Busan Shipping Police Station that “A sexual assault was committed by an employee of the company,” and on May 3, 2018, the Defendant stated that “A sexual assault victim was investigated by I located in H in the Busan Coastal Port, Busan, and “A sexual assault was committed in the vicinity of the Suwon-gu Office, Busan, on May 1, 2018.”

Then, on July 13, 2018, the Defendant made a statement to the effect that “The Defendant was sexual assaulted from E on May 1, 2018, when he was investigated into the second victim by female juveniles at the Gyeonggi-si Police Station in the East-si Police Station in the East-si, Busan-si, and women in women's department and women's department in the women's department, which were 596.”

However, on May 1, 2018, the Defendant did not have suffered sexual assault from E due to the lack of the fact that he had met E.

After all, the defendant filed a false report for the purpose of receiving criminal punishment for E and filed a false report for E.
