【Defendant A, on August 14, 2012, has a record of a crime of being sentenced to a fine of four million won for a violation of Road Traffic Act at the Gwangju District Court on the grounds of a violation of Road Traffic Act, and on May 31, 2016, a summary order of five million won for the same crime from the Gwangju District Court's Netcheon Branch.

[Criminal Facts]

1. Defendant A

A. On November 13, 2016, the Defendant violated the Road Traffic Act (drinking driving) and the Road Traffic Act (DV driver’s licenseless driving) operated a DV driver’s vehicle from the parking lot of about five meters from the 1st to the aftermath of the hospital in the direction of net 7:126% alcohol level while under the influence of alcohol leveling at 0.126% during blood.

B. An offender also aided and abetting the Defendant to drive a motor vehicle as set forth in paragraph (1) at the time, place, and place, and caused a traffic accident. The Defendant was on board in the chief lighting.

B made a false statement to the assistant F of the Circuit E police box called “A was driven at home,” and made a statement to the effect that B was unaware of the fact that B was not driving, thereby facilitating the commission of the crime.

As a result, the defendant assisted the person who committed a crime corresponding to a fine or heavier punishment to escape.

2. Defendant B, at the time and at the place specified in the above A-mentioned 1-A, was driven by himself to the above F due to the occurrence of a traffic accident while getting on the top of a passenger car driven by the above A.

After making a false statement, it complies with the drinking test and prepares a written statement related to the traffic accident.

Accordingly, the defendant, who committed a crime corresponding to a fine or heavier punishment, was allowed to escape.
