A defendant shall be punished by imprisonment for not less than two years and six months.

Seized evidence shall be confiscated as well as evidence 1, 2, 4 through 43, and 47 through 71.

Punishment of the crime

Despite the fact that the Defendant is not a narcotics handler, the Defendant dealt with psychotropic drugs-related Mesofts (one philopon; hereinafter “philopon”).

1. The Defendant: (a) collected a place from which a penphone is concealed from the sales book of the penphone ("B" and "B"; and (b) collected the place from which the penphone is concealed; and (c) intended to sell the penphone to the buyer by hiding the penphone at the place ordered by the above sales book.

Accordingly, the above sales books were ordered from D on August 10, 2020 to transfer KRW 400,000 to E’s corporate bank account (F) in the name of E, and the defendant ordered the defendant to conceal approximately 0.41g of the first floor and the second floor of the building in Songpa-gu Seoul, Songpa-gu, Seoul to the bottom of the stairs between the second floor and the second floor. The defendant concealed plastic packaging containing approximately 0.41g of the said place and transmitted the said sales books to the above sales books by photographing the above places. The above sales books were again transmitted the pictures to the above D and sold them from August 4, 2020, including the fact that from August 4, 2020, the defendant:

9. Until March 1, 99, by means of the same method 26 times in total, such as the written list of crimes (1) in the annexed sheet of crimes.

Accordingly, the defendant in collusion with the name in order to purchase and sell philophones.

2. On August 17, 2020, in order to sell phiphones in the same manner as indicated in Paragraph 1, the Defendant took approximately KRW 74 g of phiphones in Busan Dong-gu, with a view to selling phiphones, and taken approximately 164 g of phiphones over four times in total as indicated in the list of crimes in the attached Form (2).

Accordingly, the defendant accepted philophones.

3. In order to sell phiphones in the same manner as described in paragraph (1) of September 3, 2020, the Defendant holding phiphones is sealed between the first floor and the second floor of the building in Songpa-gu Seoul Metropolitan Government I.
