Reasons
Punishment of the crime
The Defendant Co-Defendant B and C (amended by Presidential Decree No. 5 million won on June 27, 2013) conspired to supply fake petroleum products by mixing them with the construction machinery at the H construction site under construction work in the Gumisisisisisisisisisisi (Gusisisisisi), even though no one manufactures, imports, stores, transports, keeps, or sells fake petroleum products, when he/she supplies them by delivering them to the construction machinery at the H construction site under construction work in the Gumisisisisisi (Gusisisisi).
1. Joint crimes with C;
A. At around 09:00 on June 6, 2012, the Defendant and C: (a) supplied 5 tons tank oil tanks via the Defendant’s management by dividing them into 5 tons tank oil tanks, 5,000 litres, and 2,033 litres, etc.; (b) arrived at the H construction site located in the Gyeongbuk-gun, Gyeongbuk-gun, the 11:40 on the same day after driving the oil tank; and (c) opened and mixing oil tanks, such as oil tanks, and the valves of the tank; and (d) used them as fuel of 32 construction machinery, such as 7,033 litres, which are 5 percent of diesel oil, by manufacturing them.
B. Around 09:00 on June 21, 2012, the Defendant and C were supplied with 5 tons tank oil tanks via the Defendant’s management by dividing them into 5 tons tank oil tanks and 2,002 liters, respectively. Around 11:00 on the same day, he/she was driving the oil tank and arrived at the H construction site located in the Gyeongbuk-gun, Gyeongbuk-gun, the 11:00 on the same day after having arrived at the H construction site. After mixing it by opening an oil tank, such as the oil tank and tank, and the valves of the tank, which are 5 percentageed by 8,782 liters, and used it as fuel for construction machinery, such as construction machinery 32 dump cump dump cump cump cump cump and fumdoz.
