Reasons
Punishment of the crime
1. The Defendant is a person who has imported a Chinese ginseng and a mountain ginseng in China, and sells it to be domestically produced and distributed as a mountain ginseng in Korea.
In order to distribute and sell cultivated mountain ginseng which is a special forest product, an official document under the name of the President of the Korea Forestry Promotion Institute under the Forestry and Mountain Villages Development Promotion Act shall be attached to the "certificate of passing the quality inspection of special managed forest products".
Accordingly, for the purpose of using in selling the mountain ginseng imported from China as domestically produced mountain ginseng, the Defendant, without authority, requested the printing company in the trade name name in Jung-gu Seoul Special Metropolitan City to pass the quality inspection of special forest products on the blank paper, and the content of the “certificate of passing the quality inspection of special forest products”, “this product passed the quality inspection under Article 189-4 of the Forestry and Mountain Villages Development Promotion Act”, “FFF in the Jung-gu Seoul Special Metropolitan City,” “Items 2014-198A-1, district number”, “A”, “A” with the inspection number, “E”, “E”, “the producer”, “the Korea Forestry Promotion Institute”, “the Korea Forestry Promotion Institute”, “the term of validity,” and “the official seal of the Korea Forestry Promotion Institute” under the name of each 3rd official seal affixed to the false and forged special forest products from December 16, 2014 to December 15, 2016.
2. Counterfeiting of forged official documents;
A. On January 8, 2015, the Defendant, at the place of business operated by the Defendant located in Dongdaemun-gu Seoul Metropolitan Government, issued a forged public document by attaching 50 of 329 copies of the forged “certificate of passing the quality inspection of special management forest products” to H, and then sending the forged public document by sending the above mountain ginseng 50 boxes to H, as if he were a person who is aware of the fact, as a person who was a person who was actually a person who passed the 50 boxes, as in paragraph (1).
