피고인은 2015. 3. 27. 13:00경 거제시 B에 있는 피해자 C(여, 74세)의 주거지 부근에서, ‘문디 새끼가 지 땅도 아닌데 차를 좀 내리대지, 와 이리댔노’라는 피해자의 욕설을 듣고 화가 나, 손으로 피해자의 멱살을 잡아 대문 밖으로 끌고 나온 뒤 땅바닥에 내리치고, 양손으로 피해자의 어깨를 잡아 그곳에 주차된 포터 차량에 2회 밀쳐, 피해자에게 약 14일간 치료를 해야 하는 턱의 표재성 손상 등의 상해를 가하였다.
