피고인은 2013. 3. 1. 20:10경 울산 울주군 B에 있는 C식당 내에서 술에 만취되어 소란을 부리다가, 신고를 받고 출동한 울산 울주경찰서 D파출소 경사 E가 인적을 묻자 "야이 씨발놈아 개새끼야"라는 등의 욕설을 하며 계속 소란을 부려, 경사 E가 피고인을 귀가시키기 위해 순찰차량에 태우고 재차 인적을 묻자 "씹할놈, 개새끼 너희가 내 인적을 알아서 뭣하냐" 라며 운전석에 앉은 경사 E의 우측 어깨 계급장을 잡아 뜯고 손을 휘두르는 등 폭행하여 경찰관의 정당한 직무집행을 방해하였다.
