1. The Defendant’s KRW 54,587,020 as well as 5% per annum from March 10, 2016 to May 2, 2016 to the Plaintiff.

1. Basic facts

A. The Plaintiff is a corporation with the purpose of leasing construction materials.

B. Two territorial buildings Co., Ltd. (hereinafter “dual land”) and the Defendant are corporations with the aim of civil engineering work, etc.

C. On April 20, 2015, the Defendant was awarded a contract with A for construction of “D’s neighborhood living facilities (hereinafter “instant building”) with the size of “D’s second and seventh floors underground on the ground level B and C, which is located on the ground level.”

On April 28, 2015, the Defendant and two territorial cases are works to fix the file structure to support the file (PILE) building of the instant building to the ground below the land where the building is to be located by using the steering gear.

A contract was entered into for the construction of the underground floor with the content of subcontracting the construction cost of KRW 1,493,800,000 (including value added tax) to two Young-gu.

On July 23, 2015, the Defendant and two-youngs form a wall in a way that they put a wood plate into wood between the construction cost of the above contract in KRW 1,650,000,000 (including value-added tax) and the earth plate in a way that they put them into wood plates.

During the period from January 2016 to October 1, 2016, the Defendant shall perform part of the construction works from two territorial seas under the instant contract.
