[2012 Highest 6853]

1. On April 17, 2012, the Defendant pretended to sell a mobile phone on the Internet NAF car page and contacted with the victim G by pretending to sell the mobile phone, but even if receiving money, the Defendant did not have any intention or ability to sell the mobile phone.

The Defendant received 90,000 won from the victim’s first bank account from H, and acquired 2,320,000 won in total over 12 times until May 15, 2012, such as the list of crimes (1) in the attached Form.

2. On May 15, 2012, the Defendant made a false statement to contact the victim D, who posted a letter of intent to purchase a mobile phone on the Internet NAF car page of the Nam-gu, Busan, Busan, with the victim D, thereby sending 300,000 won.

3. On April 1, 2012, the Defendant: (a) connected the said J building 201; (b) posted a letter stating that the victim L would want to purchase the crowdfunding on the bulletin board at the place; and (c) made a false statement to the effect that “150,000 won will be handed over to the face of remittance; and (d) sent it to the victim.”

However, in fact, the defendant did not possess a crowdfunding that will deliver to the victim, and the defendant thought that only the purchase money would be transferred from the victim from the beginning, so even if he receives a transfer of the purchase money from the victim, he will deliver the crowdfunding to the victim.
