1. The Defendant is the F.M. owned by the Defendant, the boundary of which is identical with one parcel, other than the land E, Chungcheongnam-gun, Chungcheongnam-gun, the Plaintiff-do.
Reasons
1. Judgment on the plaintiff's claim
A. In full view of the purport of the pleadings as to the claim for the performance of the duty to cooperate with the Plaintiff, the Plaintiff is the owner of 579 square meters in Chungcheongnam-gun, Chungcheongnam-do and 579 square meters in G field, and 387 square meters in G field. The Defendant is the owner of the two-story accommodation facilities and the general wood structure of the general wood structure of the attached building and the attached building attached thereto, and the Plaintiff demanded the Defendant to remove the existing Plaintiff’s wall between the Plaintiff’s land adjacent to the said land and the Defendant’s land, and to install a new wall, but the Defendant did not comply with this.

원고는 원고 소유 토지들과 피고 소유 토지 사이의 기존에 원고가 설치한 담장을 철거하고 별지 결합도면 표시 2, 3, 14, 15, 16, 17, 18, 19, 20, 21, 1, 2, 3, 4의 각 점을 차례로 연결한 지상에 벽돌(냉가벽돌 190mm × 90mm × 55mm) 1-2줄로 기초를 쌓은 후 블록(390mm × 150mm × 19mm)으로 길이 약 24m, 높이 약 1.4m의 윗면은 삿갓기화로 마감하고 옆면은 미장 및 페인트로 마감한 담장을 설치할 것을 요구하고 있는바, 위 토지들 사이에 이와 같은 담장을 설치하는 것이 그 비용이나 제반사정에 비추어 적절하다고 보이므로 피고는 원고의 위와 같은 담장설치요구에 협력할 의무가 있다.
