피고인은 같은 날 03:30경 다시 위 식당에 찾아와서 피해자에게 “내 여기 보복하러왔다.”라고 말을 하다가 함께 온 일행들로부터 제지를 받으면서 위 식당에서 나가게 되었고, 이에 두려움을 느낀 피해자는 영업 종료시간이 되지 아니하였음에도 즉시 식당의 문을 닫고 조명을 끄고 있던 중, 피고인은 같은 날 04:00경 다시 위 식당을 찾아와 식당의 문을 손으로 세게 두드리면서 “야이, 씨발년아, 문열어라. 다 때려 부숴버린다. 내 여기 돗자리에 앉아서 오늘도 내일도 장사 못하게 할거다.”라고 소리를 쳤다.
