피고인은 2016. 3. 경부터 같은 해 5. 경 사이에 서울 강북구 D, 1 층에 있는 피고인의 주거지에서, 스마트 폰을 이용하여 개설한 개인 블 로그 (E )에 성명 불상 여성의 나체 및 성기가 노출된 사진을 피고인의 페이스 북 친구인 피해자 F( 여, 22세) 의 사진과 함께 게시하여 마치 위 성명 불상 여성의 나체 및 성기 사진이 피해자의 신체를 촬영한 것처럼 보이게 한 다음, 그 아래에 “ 우리 귀요 미 걸레 가 열심히 빨고 섹하는데”, “ 곧 한국으로 돌아가는데 초대 남도 한번 도전하고 싶어 하는데”, “ 이번에 스페인 가서 스페인 남자 한 명이랑 섹 파 했습 니 돠~ 요즘 너무 정액을 좋아해서” 등 피고인이 임의로 지어낸 글을 게시하였다.
