The defendant's appeal is dismissed.

1. Summary of grounds for appeal;

A. After excluding love for mistake of facts, even if promptly with a smelting machine, metal sculptures under the entrance speed remains, and such metal sculptures cannot be deemed to have caused medical malpractice or injury to the victim, since it does not harm the body of the Defendant.

In light of the fact that the victim later received the removal of foreign substances and the removal of the frame at another hospital, it is difficult to recognize the causal relationship because metal sculptures cannot be deemed to have caused salt.

B. The sentence (one million won of fine) imposed by the lower court is too unreasonable.

2. Determination

A. 1) Determination of the assertion of mistake of facts is based on the evidence duly admitted and examined by the lower court, and the following facts are acknowledged.
