1. The plaintiff A, the defendant C is 100,500,000 won, and the defendant E is 40,500,000 won out of the above money in collaboration with the defendant C and 60.
Reasons
1. As to Plaintiff A’s claim against the Defendants
A. Defendant C and E have borrowed each of the following amounts: (a) Defendant C borrowed KRW 10 million from the Plaintiff on June 26, 2007 (after 14th of the payment period); (b) KRW 50 million on April 18, 2008 (within the payment period: May 20, 2008); and (c) KRW 40,50 million on August 4, 2014 (within the payment period: August 3, 2015).
B) Defendant E (hereinafter “Defendant E”) at the time of borrowing the above KRW 40.5 million.
Under the implied loan agreement, the borrower expressed the borrower as Defendant E and himself as its chairperson, and the plaintiff Gap trusted these appearances. [Grounds for recognition] According to the above facts of recognition as to Gap evidence Nos. 3 and 4, the purport of the whole pleadings, and the purport of the arguments, the above facts of recognition as follows: The defendant C is liable to the plaintiff for a total of KRW 1,50 million (= KRW 50 million) and the defendant Eul is jointly with the defendant Eul for a total of KRW 40,50 million and KRW 60 million among the above money (= KRW 10,500,000 and KRW 50,000,000,000,000 won) and the damages for delay calculated at the rate of KRW 5,000,000 from May 21, 2008 to KRW 4,505,000,0000,000 per annum 81,515,000,000 per annum, respectively.
B. The Plaintiff’s claim against Defendant D and the remainder of the claim against Defendant E are obligated to pay the above KRW 1.5 million to Plaintiff A and the Defendant D also jointly and severally with Defendant C. Defendant E is jointly and severally liable to pay not only KRW 40.5 million out of the above money, but also the remainder of KRW 60,000,000 among the above money.
