A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

[Criminal Power] On December 15, 2009, the Defendant was sentenced to imprisonment with prison labor for a period of one year and four months at the Suwon District Court due to a violation of the Punishment of Violences, etc. Act (joint injury) and the judgment became final and conclusive on December 23, 2009.

【Criminal Facts】

On January 16, 2009, at around 09:30, the Defendant driven a motor vehicle by a ndro in the direction located in Gwangju City, by driving a motor vehicle by re-racking C, which is not insured, and caused a traffic accident where the retaining wall installed on the right side of the front part of the said motor vehicle, with the front part of the road.

On the other hand, on September 17, 2008, D subscribed to a comprehensive insurance accident which covers a traffic accident under the condition that D pays KRW 703,830 per month to the victim Samsung Fire & Marine Insurance Co., Ltd. for the cargo vehicle owned by D.

When considering the cost of dealing with the above traffic accident, the Defendant knew D of the above traffic accident around January 16, 2009.

The Defendant and D: (a) concealed a vehicle from the previous Defendant’s driver’s vehicle while driving the above cargo, and conspiredd to conceal money from the victim company for insurance money, as if the said vehicle caused a traffic accident involving the retaining wall again; (b) around 14:00 on January 16, 2009, at the above traffic accident site, D intentionally reconcing the part of the Defendant’s driver’s vehicle on the front part of the said cargo vehicle, which caused the shock of the latter part of the driver’s vehicle on the front of the said cargo vehicle; and (c) unlike D’s phone call at around 16:04 on the same day, D reconcilates the above collision with the victim company Gwangju Center by causing the collision between D and D’s driver’s negligence while driving the above cargo on the two-lane road at the above accident at around 09:30 on January 16, 2009.
