Criminal facts

1. Any person who intends to operate a joint-use credit business by the Defendants shall register with the competent authority having jurisdiction over the pertinent place of business for each place of business, and if the Defendants operate a credit business without registration, he shall not receive the interest exceeding the annual interest rate of 24%.

Nevertheless, Defendant A and Defendant B were in charge of performing unregistered credit business on a systematic basis by using a post-registered credit business with the knowledge of the future, etc., at least 24% of the annual interest rate, and they were in charge of taking overall charge of organization as joint representatives (hereinafter referred to as “representative”) and of performing the duties of giving the duties to each assistance officer and managing account books and funds, and Defendant C was in charge of receiving interest and principal from the debtor to another person’s account under the name of the latter (hereinafter referred to as “speed deposit”); Defendant D was in charge of taking the role of obtaining the interest and principal from the debtor (hereinafter referred to as “severed deposit”) and reporting the result thereof to the joint representatives (hereinafter referred to as “severed deposit”). Defendant E was aware of the debtor’s personal information, desired amount of loan, etc., and shared them on a telegram reading room used by the Defendants, etc. (hereinafter referred to as “surak field”), Defendant GF, Defendant HO, Defendant J., Defendant 1, and Defendant J.

The Defendants of unregistered credit business in collusion with each other, from January 12, 2018 to November 26, 2019, have an office and a lodging in the Q building R and the Sinnam-si Si Sinnam-si, and without registering with the competent authority, the Defendants of the unregistered credit business in collusion with each other. The number of Defendant A’s sole representative system from January 25, 2018 to October 31, 2018, as shown in attached Table 1, shall be 537,251,250 won in total, from November 1, 2018 to August 31, 2019, as shown in attached Table 2.
