1. Of the judgment of the court of first instance, the part against the defendant exceeding the following amount ordered to be paid shall be revoked.

1. At the time of the instant accident, the following facts are as follows: (a) the Defendant’s vehicle in the situation of collision with the Korean Economic T-distance Intersection of Jung-dong, Jung-gu, Seoul on July 23, 2018 at the time of the instant accident: (b) the adjacent side of the Plaintiff’s vehicle entering the above intersection from the right side of the vehicle in the direction of the Defendant’s vehicle and the adjacent side of the Plaintiff’s vehicle entering the above intersection to the left at the left side of the said intersection; (c) the total repair cost of KRW 13,69,400 (the repair cost of the Plaintiff’s vehicle) less self-paid KRW 50,000,000 from the payment of the insurance proceeds of the collision with the insurance proceeds of KRW 13,69,400 (the repair cost of the Plaintiff’s vehicle); and (d) there is no dispute over the payment date of the insurance proceeds secured by self-owned vehicle damage security (based on recognition); and (d) the statements or images

2. Determination

가. 과실 비율 앞서 본 증거들에 의하면 인정되는 다음과 같은 사정들, 즉 ① 이 사건 사고가 발생한 삼거리 교차로는 그 형태가 ‘ㅜ’형으로 피고 차량의 진행방향(ㅡ)으로는 신호등에 의한 교통정리가 되고 있는 곳이나, 가지 차로인 원고 차량의 진행방향에서는 신호등이 설치되어 있지 않은 폭이 좁은 도로인 점, 도로교통법 제5조, 제4조, 도로교통법 시행규칙 제6조 제2항 [별표 2]의 각 규정을 종합하면 위 삼거리 교차로의 원고 차량 진행방향에 비보호좌회전을 허용하는 표시가 없는 경우 좌회전은 원칙적으로 허용되지 않는다고 봄이 상당한데, 원고 차량이 위 교차로에서 좌회전을 하던 중 이 사건 사고가 발생한 점, 도로를 통행하는 차마는 교통안전시설이 표시하는 신호 또는 지시에 따라야 하고, 삼거리 교차로의 직진 방향(ㅡ)에만 교통안전시설이 설치되어 있는 경우 위 삼거리 교차로는 직진 방향에 설치된 교통안전시설이 표시하는 신호에 따라서 교통정리가 행하여 지고 있다고 볼 것이므로 가지 차로에 비보호좌회전 표시가 없는 이상 가지...
