Reasons
Punishment of the crime
From around 2014, the Defendant has been working as the secretary of the village conference in the Cheongju-si, the petition district.
1. In promoting the construction project of the New Power Station in mid-to long-distance, etc. whose power supply is vulnerable to the supply of electricity, the Ministry of Construction and Transportation paid 1,463,940,000 won to the President of the said D Village and the Joint Nonghyup Bank Co., Ltd. (Account Number:G) in the name of residents of the village other than the President of the said D Village, on five occasions from June 23, 2014 to June 2, 2015, in consultation with D residents.
Upon delegation from the representative of residents of the above D village, the defendant transferred the above D village joint project expenses to the passbook (Account Number H) in the name of the defendant, and embezzled them for personal purposes, such as light survey expenses, food, and melting money, etc. by arbitrarily withdrawing KRW 300,000 from the cash payment machine located in Cheongsan-gu, Chungcheongnam-gu, Cheongsan-si, on October 11, 2014, and using it for the personal purposes, such as light survey expenses, etc. from June 14, 2015, from that time until June 14, 2015, as shown in the attached list of crimes, the defendant arbitrarily withdrawn KRW 46,304,957, total sum of community joint project expenses, and embezzled them for a total of 39 times, as shown in the attached list of crimes.
2. On May 2015, the above D Village Association did not receive KRW 4,437,00 in the balance of the community project cost out of the community support project cost from the Korea War. In order to receive the balance of the community joint project cost, the village joint project should be implemented, but if no longer the project is implemented, the defendant is together with the Chairperson F of the Village and I Representative J (Suspension of Prosecution on each same day). The fact is that D Village Association is a multi-family housing for the elderly who purchased with the community joint project cost supported by the D Village Association from the Korea War, which is a multi-family housing for the elderly with the German elderly who purchased with the project cost supported by the D Village Association from the Korea War.
