1. Details of the disposition;

A. The Plaintiff is a person who worked as a mining source from June 2004 to September 2008, such as working in the Taebae Mining (ju).

B. On August 9, 2013, the Plaintiff filed an application with the Defendant for disability benefits for the “hychine dysia” (hereinafter “hysia”), and the Defendant rendered a judgment on the disability grade 14-1 (one-way average Cheonghysia is more than 40 cc, but less than 70 cc, on the ground that the right ear’s ear was not related to occupational noise) only to the Plaintiff, and that the right ear’s ear was not related to occupational noise.

2. Whether the disposition is lawful;

A. The Plaintiff’s result of the Plaintiff’s right-to-hand hearing shows farming or reverse 90dB. The Plaintiff’s noise was exposed not only to long-term noise at the noise-generating place, but also to the left-hand ear, and as such, the noise level hearing was recognized, the noise level hearing for the right-hand ear should be recognized as an occupational injury.

Therefore, the Plaintiff’s disability grade falls under class 9 of class 9 (one person whose average lucence loss of one return is at least 90dB). Even if another cause has occurred to the right-hand side of the household, the lucence loss is recognized in the same degree as that of the left-hand side, so at least the Plaintiff’s disability grade falls under class 5 of class 11 (the average lucence loss of two return is at least 40dB, respectively).

Therefore, the instant disposition taken on a different premise is unlawful.
