Defendant

A is a business owner of the D entertainment room in the second floor of the North Korean-gu building C at the port of port (the external signboard of a business establishment that completed the registration of a general game providing business with the trade name "D entertainment room" from the North Korean head of the Gu at the port of port on July 5, 201) and the defendant B is a person who worked as the manager of the D entertainment room at the above D entertainment room.

Defendants conspired, from July 22, 2013 to 2014;

4. 2. 19:00경까지 위 D오락실에서 ‘황금포커성’게임기 40대, 흑룡성’게임기 30대를 설치하고, F, G, H 등을 종업원으로 고용한 후, 그 곳을 찾는 불특정 다수의 손님들로 하여금 게임기에 500원 동전을 투입하고 자동실행장치인 속칭 똑딱이’를 이용하여 자동으로 게임을 진행한 후 게임 화면에 나타나는 카드의 조합에 따라 정해진 일정한 점수를 획득하게 하고, 그와 같이 획득된 점수는 게임기 좌측 하단‘BANK'창에 적립되고, 손님들로부터 게임물의 이용을 통해 획득한 위 ’BANK‘ 창에 적립된 금액의 반환을 요구받으면 그 금액에 해당하는 점수가 기재된 재이용권(10,000점 당 10,000점 1권 1장)을 지급하며, 이후 손님들로부터 위 재이용권의 교환을 요구받으면 그 점수에 해당하는 금액을게임기 동전투입구에 넣어 주어 손님들이 위 게임을 다시 할 수 있게 함으로써 위 재이용권의 교환가치를 부여함과 동시에 손님들이 위 재이용권을 불상의 장소에서 다른 손님들에게 판매하여 현금화가 가능하도록 하였다.
