1. The Defendant’s KRW 15,290,814 as well as the Plaintiff’s annual rate from May 9, 2014 to June 23, 2016.
Reasons
1. Basic facts
A. The Plaintiff is an insurer who has entered into a comprehensive automobile insurance contract with respect to A vehicle (hereinafter “Plaintiff”), and the Defendant is a mutual aid contractor who has entered into a mutual aid agreement with respect to B vehicle (hereinafter “Defendant vehicle”).
나. 원고 차량이 2013. 12. 6. 20:50 경 화성시 비봉면 서해안 고속도로 상행 315km 지점 2차로를 진행하다가 1차로로 차로를 변경한 후 앞서 차량정체로 정차한 C 차량(이하, ‘1 차량’이라 한다)의 후미를 추돌하고 1 차량이 밀리면서 그 앞에 정차한 D 차량(이하, ‘2 차량’이라 한다)의 후미를 추돌하는 사고(이하, ‘1차 사고’라 한다)가 발생하였다. 다. 위와 같이 원고 차량이 추돌사고를 일으켜 급정지하자 원고 차량을 뒤따르던 피고 차량이 원고 차량의 후미를 추돌하고 그 충격으로 원고 차량이 우측 앞으로 튕겨져 나가면서 1 차량과 2차로를 진행하던 E 차량(이하, ‘4 차량’이라 한다)을 들이 받고, 그 충격으로 1 차량이 2 차량을, 2 차량이 다시 그 앞에 있던 F 차량(이하, ‘3 차량’이라 한다)을 연쇄적으로 추돌하는 사고(이하, ‘2차 사고’라 한다)가 발생하였다. 라.
