The judgment of the court below is reversed.

Defendant shall be punished by a fine of KRW 3,000,000.

The above fine shall not be paid by the defendant.

Summary of Grounds for Appeal

Although the Defendant appeared four times more than 100 the game product of this case and provided it for use with knowledge that it is different from the content of the rating classification, the lower court acquitted the Defendant on the ground that he mispercing the fact.

Judgment

Before the judgment on the grounds for appeal by the prosecutor ex officio, this case’s charges are examined by the prosecutor at the trial, and no person shall provide game products different from the classified contents for distribution or use, or display or keep the same for such purposes.

The Defendant, from May 13, 201 to May 16, 2011, operated a game site of D on the second floor of the Manam-si, Sungnam-si, the second floor of the C building of Sungnam-si, and installed 50 game machine 50 games, which are game products for the entire use.

게임물등급위원회에서 등급분류를 받은 ’굿씨플러스‘는 일정 시간 동안 주어진 10발의 물방울을 가지고 레버와 버튼을 이용하여 움직이는 물고기를 맞추어서 일정 점수를 획득하면 경품을 취득하는 게임으로, ① 단순 게임진행으로는 경품획득이 어렵고 이용자의 실력이 충분히 반영되어야 경품획득이 가능한 게임물이며, ② 100초 동안 점수를 획득할 수 있는 각 어종은 등급 심의용 게임설명서에 따라 일정한 출현 빈도수를 유지하도록 되어 있었음에도, 위 게임장의 ’굿씨플러스‘ 게임은 ① 게임을 하는 사람이 게임시작시 정해진 조준점을 옮기는 것 이외에는 레버를 조작할 필요가 거의 없고 버튼 또한 누를 필요 없이 이른바 ’똑딱이‘라 불리는 기구를 이용하여 게임이 자동실행진행종료되어 이용자의 실력이 아닌 우연에 의하여 결과가 좌우되고, ② 100초 동안 4회만 출현하여야 하는 ’거북이‘(점수 500점 획득)가 5회 내지 6회 출현하는 등 등급분류를 받은 게임물과 다른...
