A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment became final and conclusive.

1. 업무 방해 피고인은 2017. 1. 31. 23:22 경 보령시 E에 있는 피해자 F이 운영하는 G 편의점에서 술에 취한 채 피해자에게 담배 1 갑을 주문한 후 담배 값으로 100 원짜리 5개를 건넸고 이에 피해자가 4,000원을 더 달라고 요구하자 “ 너 씹새끼 죽고 싶어 너 장사 다하고 싶어 죽여 버린다” 고 말하고, 피해자가 카운터 안쪽에서 경찰에 신고를 하려고 하자 계산대 옆 바코드 스캐너를 들고 피해자를 때릴 것처럼 위협하고, 카운터 계산대 위로 뛰어 올라가고, 피해자가 피고인을 피해 다른 곳으로 이동하자 편의점 내부를 뛰어 다니며 피해자를 쫓아다니는 등 소란을 피워 같은 날 23:35 경 출 동한 경찰관들에게 공무집행 방해죄의 현행 범인으로 체포될 때까지 약 13분 동안 위력으로 피해자의 편의점 영업 업무를 방해하였다.
