A defendant shall be punished by imprisonment for not less than two years and six months.

Punishment of the crime

On October 12, 2012, the Defendant was sentenced to imprisonment with prison labor for a violation of the Act on the Control of Narcotics, etc. at Busan District Court on April 8, 2016, and the execution of the sentence was completed at the Busan Detention Center on April 8, 2016.

"2016 Highest 1932"

1. The Defendant is not a person handling narcotics, etc., and thus, shall not receive, trade, administer, or possess the psychotropic drugs camba (hereinafter referred to as “camphones”).

A. On May 26, 2016, around 17:00, the Defendant received approximately 10 ghopon, which is contained in vinyl paper, from H, which was parked in front of the Busan Jin-gu P building, in front of the Busan Jin-gu P building.

B. At around 18:00 on May 30, 2016, the Defendant: (a) parked in the front of the “D” convenience store located in Yeonsu-gu Incheon Metropolitan City, Yeonsu-gu, and purchased and sold 10 ghonphones received from A, such as the preceding paragraph, from G introduced from A; and (b) purchased and sold honphones by receiving two million won from B.

C. On June 8, 2016, around 14:00, the Defendant sold the said H from the frontway of the Busan Jin-gu P building in Busan, to pay KRW 2.6 million with the price after selling the said H.

On June 8, 2016, the Defendant: (a) stopped in Q apartment parking lot at Kimhae-si, Kimhae-si, divided R and philopon into one-time medication of R and philopon into coffees; and (b) injected 0.05g of philopon into coffees by dilution it.

E. On June 8, 2016, around 23:30 on June 23, 2016, the Defendant: (a) placed approximately 18.31g of philophones purchased from H, such as paragraph (c) of the foregoing 1, on the alleyway, and carried a philophone, in order to sell approximately 18.31g of philophones purchased from H to L who was introduced by A.

2. The criminal defendant who violates the Act on the Control of Narcotics, etc. shall not smoke marijuana because he/she is not a handler of narcotics;
